2. Mobile and WhatsApp Communication Policy

When you provide your mobile number, you consent to receive messages related to our Services, including notifications, account communications, and, if you opt in, marketing offers, whether sent by SMS or WhatsApp. Your opt-in will not be shared with third parties for their own marketing purposes.

• Opt-Out: Reply STOP to any SMS message, or tell us directly on WhatsApp, to opt out at any time.
• Help: Reply HELP for support, or contact us directly.
• Frequency: Message frequency varies based on your interactions with us.
• Cost: Standard message and data rates may apply per your carrier's terms.

Phone numbers may be processed by our service providers (including our CRM and communications platform, GoHighLevel) only to deliver the messages you have consented to receive.

3. Information We Collect

We do not knowingly collect racial or ethnic origin, religious beliefs, health information, biometric data, or information relating to a child.

4. Where We Get Your Information

• Directly from you, when you fill out a form, book a call, sign up, or contact us.
• From your device, through cookies, pixels, and similar technologies on our Site.
• From advertising partners, such as Meta and Google, who deliver our advertising.
• From service providers, including our CRM and website platform (GoHighLevel) and payment processor (Stripe).
• From publicly available sources, such as business directories and public records.

5. How We Use Your Information

We use personal data for the following purposes, consistent with the PDPL's requirement that processing be based on a lawful basis such as your consent, the performance of a contract with you, or our legitimate business interests:

• Provide and operate the Services — account setup, billing, customer support, communications about your account.
• Sales and marketing — respond to inquiries, follow up on leads, send promotional messages where you have consented, and retarget visitors on advertising platforms.
• Analytics and improvement — understand how the Site and Services are used, diagnose problems, and develop new features.
• Advertising — measure ad performance and build audiences for Meta, Google, and similar platforms.
• Quality assurance and training — review and use call recordings to train our team and improve service.
• Security and fraud prevention — detect, investigate, and prevent fraudulent or unauthorized activity.
• Legal compliance — comply with applicable UAE laws, court orders, and regulatory requirements.
• Business operations — accounting, recordkeeping, audits, and corporate transactions.

6. How We Share Your Information

We require our service providers to use personal data only for the purposes we authorize, under written confidentiality and security obligations consistent with the PDPL.

7. No Sale of Personal Data; Advertising Sharing and Opt-Out

We do not sell personal data for money. We do share certain identifiers and online activity data with advertising partners (such as Meta and Google) so they can deliver and measure advertising on our behalf. You may opt out of this sharing at any time by:

• Emailing bp@parkberrygroup.com with the subject line "Opt Out of Advertising Sharing."
• Adjusting your ad preferences directly within Meta, Google, or the relevant advertising platform.
• Declining non-essential cookies through our cookie banner or your browser settings.

We do not knowingly collect, sell, or share the personal data of anyone under 18 years of age.

8. Cookies, Pixels, and Tracking Technologies

We use cookies, pixels, and similar technologies on our Site to keep you logged in and remember your preferences, measure traffic and performance, and deliver and measure advertising (such as the Meta Pixel and Google Ads tracking).

Managing cookies: you can accept, reject, or customize non-essential cookies through the cookie banner on our Site, or block and delete cookies through your browser settings.

We do not use session replay technology on our Site.

9. Call Recording

We record sales, onboarding, and support calls for quality assurance, training, recordkeeping, and dispute resolution. At the start of each call, we provide a verbal notice that the call is being recorded. Consistent with UAE Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services, your consent to the recording may be inferred from continuing the call after this notice. If you do not wish to be recorded, please tell us at the start of the call and we will end or pause the recording. Recordings are stored securely, accessible only to authorized personnel and our service providers, and retained as described in Section 10.

10. Data Retention

You may request deletion at any time as described in Section 11. After deletion is processed, we may retain limited information necessary to comply with legal obligations, resolve disputes, prevent fraud, and enforce our agreements.

11. Your Privacy Rights Under the UAE PDPL

Under the UAE Personal Data Protection Law, you have the right to:

• Be informed — know how your personal data is collected and used, as described in this Policy.
• Access — request a copy of the personal data we hold about you.
• Correct — request that we correct inaccurate or incomplete personal data.
• Erase — request deletion of your personal data, subject to our legal and legitimate business retention needs.
• Restrict processing — request that we limit how we use your personal data in certain circumstances.
• Object — object to our processing of your personal data for direct marketing or other purposes.
• Withdraw consent — withdraw consent at any time where our processing relies on your consent, without affecting processing that occurred before withdrawal.
• Data portability — request your data in a structured, commonly used format, where technically feasible.
• Non-discrimination — we will not deny you Services or treat you differently for exercising these rights.

To exercise any of these rights, contact us as described in Section 12. If you are not satisfied with our response, you may lodge a complaint with the UAE Data Office, the federal authority responsible for enforcing the PDPL.

We will acknowledge your request promptly and respond within a reasonable time, and in any case within the timeframe required by the PDPL. We may ask you to verify your identity before processing a request, using information we already hold about you, to protect your data from unauthorized access. You may designate an authorized representative to submit a request on your behalf with your written, signed authorization.

13. Cross-Border Data Transfers

Some of our service providers, including our CRM/website platform (GoHighLevel) and payment processor (Stripe), may process or store personal data on servers located outside the United Arab Emirates. Where we transfer personal data outside the UAE, we take steps consistent with the PDPL's cross-border transfer requirements, including relying on service providers that maintain appropriate technical, contractual, and organizational safeguards to protect your data to a standard consistent with UAE law.

14. Children's Privacy

The Site and Services are not directed to individuals under 18. We do not knowingly collect personal data from children. If you believe we have collected information from a child, contact bp@parkberrygroup.com and we will delete it.

15. Data Security

We use reasonable administrative, technical, and physical safeguards to protect personal data, including encryption in transit, access controls, and due diligence on our service providers. However, no method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security.

16. Third-Party Links

Our Site may contain links to third-party websites and services. This Policy does not apply to those third parties, and we encourage you to review their privacy policies separately.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the most recent change. If we make material changes, we will notify you by posting a notice on our Site or by email. We review this Privacy Policy at least once every six months.
